1. General Provisions

1.1 This privacy policy regulates the principles regarding the collection, processing and storage of personal data. Personal data is collected, processed and stored by the controller of personal data Atelier Duree OÜ (hereinafter the data processor).

1.2 A data subject in the sense of the privacy policy is a customer or other natural person whose personal data is processed by the data processor.

1.3 A customer in the sense of the privacy policy is anyone who buys goods or services from the website of Atelier Duree OÜ.

1.4 The data processor complies with the principles of data processing stipulated in legislation, among other things, the data processor processes personal data legally, fairly and securely. The data processor confirms that personal data has been processed in accordance with the provisions of legislation.

2. Collection, Processing and Storage of Personal Data

2.1 The personal data that the data processor collects, processes and stores is collected electronically, mainly via the website and email. The data processor may also collect and store data in other ways (including on paper).

2.2 By sharing his personal data, the data subject (customer) gives the data processor the right to collect, organize, use and manage personal data for the purpose defined in the privacy policy, which the data subject directly or indirectly shares with the data processor when purchasing goods or services on the website or in another way (in person).

2.3 The data subject (client) is responsible for ensuring that the data provided by him is accurate, correct and complete. Knowingly providing false information is considered a violation of the privacy policy and is punishable as a misdemeanor. The data subject is obliged to immediately notify the data processor of changes in the provided data.

2.4 The data processor is not responsible for damage to the data subject or third parties caused by the data subject providing false information.

3. Processing the Personal Data of Customers

3.1 The data processor may process the following personal data of the data subject:
– First and last name
– Date of birth and/or social security number
– Contact information: phone number, e-mail address, residential address
– Bank account and payment card information
– Information contained in the document certifying the right to drive

3.2 In addition to the above, the data processor has the right to collect data about the customer that are available from public sources (including registers managed by the state).

3.3 The legal basis for the processing of personal data is Article 6(1)(a), (b), (c) and (f) of the General Regulation on the Protection of Personal Data, according to which the data processor has the right to process personal data if:
– the data subject has given his consent to process his personal data for one or more specific purposes;
– the processing of personal data is necessary for the performance of a contract concluded with the participation of the data subject or for taking measures prior to the conclusion of the contract in accordance with the request of the data subject;
– the processing of personal data is necessary to fulfill the legal obligation of the data controller;
– processing of personal data is necessary in the case of a legitimate interest of the data controller or a third party, unless such interest is outweighed by the interests of the data subject or the fundamental rights and freedoms for which personal data must be protected, especially if the data subject is a child.

4. Purposes of Processing and the Maximum Period of Storage of Personal Data

4.1 Purpose: security, safety and potential offences. Maximum storage time – according to the deadlines specified in the law.

4.2 Purpose: order processing. Maximum storage time – 3 years.

4.3 Purpose: ensuring the functioning of e-shop (rental environment) services. Maximum storage time – 3 years.

4.4 Purpose: customer management. Maximum storage time – 3 years.

4.5 Purpose: financial reporting and accounting. Maximum storage time – according to the deadlines specified in the law.

4.6 Purpose: marketing. Maximum storage time: 3 years.

4.7 The data processor has the right to share personal data of data subjects (customers) with third parties, if it is necessary for the purposeful and smooth provision of the offered products and services. Third parties can be, for example (non-exhaustive list): authorized data processors, accountants/auditors, transport and courier companies, payment service companies and banks.

4.8 When processing and storing the data subject’s personal data, the data processor implements all reasonable and proportionate measures that ensure the protection of the data subject’s personal data against accidental or illicit destruction, modification, disclosure and any other illicit processing.

4.9 The data processor stores the data of the data subjects depending on the purpose of the processing, but not longer than 5 years.

5. Rights of the Data Subject

5.1 The data subject has the right to get access to his personal data and to consult them.

5.2 The data subject has the right to receive information about the processing of his personal data.

5.3 The data subject has the right to supplement or correct inaccurate data.

5.4 If the data processor processes the data subject’s personal data on the basis of the data subject’s consent, the data subject has the right to withdraw the consent at any time.

5.5 The data subject can contact the e-store customer support at info@gs-adventures.eu to exercise their rights.

5.6 The data subject can file a complaint with the Data Protection Inspectorate to protect his rights.

6. Final Provisions

6.1 These data protection conditions have been drawn up in accordance with Regulation (EU) No. 2016/679 of the European Parliament and of the Council on the protection of natural persons in the processing of personal data and the free movement of such data and on the repeal of Directive 95/46/EC (General Regulation on the Protection of Personal Data), Personal Data Protection of the Republic of Estonia law and legislation of the Republic of Estonia and the European Union.

6.2 The data processor has the right to partially or completely change the data protection conditions at any time, informing the data subjects about the changes via the website (www.gs-adventures.eu).
